Terms of use
These terms govern the use of the website pulsekite.com, including its live demo (together, "the site"). They do not govern the PulseKite software itself; see section 7.
1. Who we are
The site is operated by [to be supplied: legal name, address, e-mail] ("we", "us"). In these terms, "you" means the person using the site and, where that person uses it on behalf of an organization, that organization as well.
2. Acceptance
By browsing or otherwise using the site you accept these terms. If you do not accept them, do not use the site. If you use the site on behalf of an organization, you confirm that you are authorized to accept these terms for it. The site is intended for businesses and IT professionals.
3. The site is informational
The site presents PulseKite, a read-only dashboard for Microsoft Configuration Manager that the customer installs on its own site server. Its content is general information about the product. It is not an offer capable of acceptance, a specification, a commitment to any feature, price, schedule or roadmap, or professional advice about your environment. Only a signed agreement with us (section 7) binds us regarding the product.
The "request a demo" form on the site is not active: it checks the fields in your browser and sends nothing. Submitting it does not create any request, contract or obligation.
4. The live demo
The live demo is a static copy of the PulseKite dashboard running in your browser on fictional data of an imaginary company, Contoso. Every name, computer, user, number and finding in it is invented; any resemblance to a real organization, person or system is coincidental. The demo is view-only: it is connected to no Configuration Manager site, server or computer, it refuses every change, and nothing you do in it is sent anywhere or performs any action. Figures in the demo illustrate how the product presents information and are not a measurement, benchmark or promise of results in your environment.
5. No warranty of the site's content
We take care to keep the site accurate, but the site and its content, including the demo, are provided "as is" and "as available". To the fullest extent permitted by law, we give no warranty, express or implied, that the content is complete, accurate or up to date, that the site will be available without interruption or error, or that it is fit for any particular purpose. Do not rely on the site's content when making decisions about your systems without confirming them with us in writing.
6. Intellectual property
The name PulseKite, the bird logo, the design of the site, its text, images, screenshots, animations and code, and the software shown in the demo are owned by us or by our licensors and are protected by copyright, trademark and other intellectual property laws. Nothing in these terms or on the site grants you any license or right in them, except the limited right to view the site in a web browser for your own information and for evaluating PulseKite. You may not copy, reproduce, modify, distribute, publish, frame or create derivative works from any part of the site, or use the PulseKite name or logo, without our prior written permission, except as the law expressly allows.
7. The PulseKite software
The PulseKite software is licensed, not sold, and only under a separate written license agreement between us and the licensed organization, together with a signed license issued for that organization. That agreement alone governs the software's use, support, warranties and liability. Nothing on the site, including the demo, grants a license to the software or forms part of such an agreement, and in case of any conflict the license agreement prevails.
8. Permitted use and prohibited conduct
You may use the site lawfully, for your own information and for evaluating PulseKite. You must not, and must not help or allow anyone else to:
- scrape, crawl, harvest or bulk-download the site or the demo's data by automated means, except search engine crawlers that follow the site's
robots.txt; - attack the site or its host, including by probing, scanning or testing their vulnerability, attempting unauthorized access, denial of service, flooding, or introducing malware or any other harmful code;
- attempt to bypass, disable or interfere with the demo's view-only nature or with any security feature of the site, including by crafting requests intended to change data, reach a server or run code;
- reverse engineer, decompile or extract the source of the software shown in the demo, except to the extent the law expressly allows despite this restriction;
- present the demo, its screenshots or its fictional data as real data, as data of a real organization, or as a measurement of the product in any environment;
- frame the site, or use it in a way that implies that we endorse you or are affiliated with you;
- use the site in breach of any law or of the rights of any person.
If you believe you have found a security vulnerability in the site, please report it to us at the contact address below and do not exploit or disclose it before we have had a reasonable opportunity to fix it.
We may suspend or block access to the site for anyone who breaches these terms.
9. Third-party trademarks
Microsoft, Configuration Manager, Microsoft Configuration Manager, System Center Configuration Manager (SCCM), ConfigMgr, Windows, Windows Server, Active Directory, Microsoft Edge, Excel and .NET are trademarks of the Microsoft group of companies. Chrome is a trademark of Google LLC. All other trademarks mentioned on the site belong to their respective owners. They are used only to identify the products PulseKite works with; PulseKite is an independent product and is not affiliated with, sponsored by or endorsed by Microsoft or any other trademark owner.
10. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any damage, loss or expense arising out of or in connection with the site or its content, including the demo, or with any reliance on them, whether direct, indirect, incidental, special or consequential, including loss of profits, revenue, data, business or goodwill, however caused and whatever the legal theory, even if we were told that such damage was possible. The site is provided free of charge; to the extent our liability cannot be excluded, our total liability in connection with the site is limited to one hundred (100) New Israeli Shekels. Nothing in these terms limits liability that cannot be limited by law, such as liability for fraud or for damage caused intentionally.
You will indemnify us for any claim, loss or expense, including reasonable legal fees, arising from your breach of section 8.
11. Privacy
What the site does with information about its visitors is described in the privacy policy, which forms part of these terms. In short: the site sets no cookies, loads nothing from other companies, and the demo request form sends nothing.
12. Accessibility
Our accessibility commitments and the details of our accessibility coordinator are in the accessibility statement.
13. Changes to the site and to these terms
We may change, suspend or discontinue the site or any part of it, including the demo, at any time and without notice. We may also change these terms; the date at the bottom of this page shows when they were last changed. A changed version applies from its publication on the site, and your use of the site after that means you accept it.
14. Governing law and jurisdiction
These terms and any dispute arising out of or in connection with the site are governed by the laws of the State of Israel, without regard to its conflict of laws rules. The competent courts in the district of Tel Aviv-Jaffa have exclusive jurisdiction over any such dispute, and you and we submit to their jurisdiction.
15. General
If a court finds any provision of these terms invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the rest of the terms remain in effect. Our failure or delay in enforcing a provision is not a waiver of it. These terms, together with the privacy policy, are the entire agreement between you and us about the site. You may not transfer your rights under them; we may transfer ours to a successor of our business. The English version of these terms is the binding one.
16. Contact
Questions about these terms, requests for permission and security reports: [to be supplied: contact address].
